Earlier this month, Tunisia’s President announced in a speech: “I propose equality inheritance to become law.” Currently in Tunisia, men typically inherit double what women inherit. The proposed change has attracted criticism from conservative Muslim groups, who argue that inheritance should be based on the Qurʾān—even though, according to Tunisia’s 2014 Constitution, Islamic law has no legal status (see our Country Profile on Tunisia here).
In our Islamic Law in US Courts collection, there is a case from 1891 in which a Maryland court refers to “the Mahometan law of India” in deciding which family member is entitled to inherit the life insurance money when the policyholder and beneficiary die in the same event.
