Recent Scholarship: Islamic Criminal Law Conference

During last month’s conference at the University of Tehran on “Criminal Law Development in Muslim-Majority Countries,” Paul H. Robinson delivered the opening and closing remarks. His remarks were recently published in Penn Law School’s Public Law & Legal Theory Research Paper Series:

“Codifying a Sharia-based Criminal Law in Developing Muslim Countries”

The opening remarks discuss the challenges of codifying a sharīʿa-based criminal code, drawing primarily from Robinson’s experiences directing codification projects in Somalia and the Maldives. The closing remarks apply many of those lessons to the current situation in Iran. Included is a discussion of the implications for Muslim-majority countries of Robinson’s social psychology work on the power of social influence.

The paper is available open-access from SSRN here.
